orphaned rights_you knew i had to say something

...you knew it was coming.

I consider myself blessed with this need to speak my mind on the rights of artists. But, after reading what all is meant by "orphaned works" and moonbeam's lovely journal, [link] , I find myself in conflict.

ever notice how laws are worded so there can be loopholes? because no one speaks like how a law is worded, it is sometimes just left up to interpretation instead of original intent. i am not sure how this law would affect us all, but i do know one thing.

WHAT ABOUT ALL THOSE PIECES OF MINE THAT ARE OUT THERE. those that people claim to not know who did it. then some corporation comes along, and claims "orphaned law" and then they are free to use it however they want? what the hell?

so, you see my issue. it doesnt matter if they do or do not pass this, if they cant fix the original problems with artists rights online. you have to attack the rampant wildfire of online plagiarism before you can try to organize for orphaned works.

i dont know. more thoughts to come as i have to go clothes shopping.

You're quite right. Whenever you publish your own work it is attributed to yourself (i.e not an orphan work). But if it gets ripped and re-ripped twenty times that attribution to the creator gets lost, and anyone finding the work in this situation has no way of tracking the original author.

I don't think the proposed law is so bad on its own; the main risk is that it gives the potential for relatively insignificant rips to escalate into creating "orphaned" works which could lead to art being used for large commercial purposes without permission.

It alarms me that while copyright durations keep getting extended for corporations they keep getting weakened for individuals. When lawmakers work only for the economy and not the people who make it possible the system can't survive. If one country adopts this sort of law its intellectual community will simply move to a country with better laws, so much for helping the economy.
