US DEVIANTS ARE BEING SOLD...

Journal Entry: Mon Jul 9, 2007, 1:00 PM

Well, I now truly believe it is time to contact a lawyer. Upon searching my own name, I came across a photobucket account hosting one of my images. Yes, the file name did still contain the "_by_starfantazy.jpg" ending you get when you save it from da, but the girl apparently decided to put her name as the creator...

Well, upon some searching for a link to contact someone about this, I found a link to "buy prints". It took me to a site called "qoop" and apparently, I can purchase a print of mine on a hoodie for $33 from someone I don't know. I am so fucking pissed atm, that I really can't contain myself enough to stay quiet on this one. When I went to the forum, they said they don't help people with that.

This isn't the biggest rant...anyone who rips any image from da can sell it...even without a paid subscription to the site!!! Fuck......... And apparently A LOT OF ARTISTS ARE BEING SOLD HERE!!!!!!!! Yes, you can buy cups, shirts, keyrings....maybe even books. It's fucking time for da to have a representative who can be a legal voice in cases like this...where a lot of the artists are affected and when money is involved. I want to know if someone made money on my stuff...and since I have to agree to da's submission agreement, i feel like they should also offer protection or a way to communicate on this level with other sites.

Anyways, go to photobucket, search for your name, a piece name, whatever. When you find something, click the image, go to "view this album". when in the album, click "buy prints" to see that you can in fact buy them.

Artists contacted already whom I have found...:iconcrisvector: :iconjesar: :iconhe1z: :iconwirestyle: :iconblackeri: :iconlarafairie: :iconnkeo: :iconprincess-of-shadows: :icondivineerror:

search on photobucket.com to see if you are affected by this.

*Edit*(From the U.S. Copyright website. [link])
"When is my work protected?
Your work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device.

Do I have to register with your office to be protected?
No. In general, registration is voluntary. Copyright exists from the moment the work is created. You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work. See Circular 1, Copyright Basics, section “Copyright Registration.”

Why should I register my work if copyright protection is automatic?
Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. Finally, if registration occurs within 5 years of publication, it is considered prima facie evidence in a court of law. See Circular 1, Copyright Basics, section “Copyright Registration” and Circular 38b, Highlights of Copyright Amendments Contained in the Uruguay Round Agreements Act (URAA), on non-U.S. works.

I’ve heard about a “;poor man’s copyright.” What is it?
The practice of sending a copy of your own work to yourself is sometimes called a “;poor man’s copyright.” There is no provision in the copyright law regarding any such type of protection, and it is not a substitute for registration.

Is my copyright good in other countries?
The United States has copyright relations with most countries throughout the world, and as a result of these agreements, we honor each other's citizens' copyrights. However, the United States does not have such copyright relationships with every country. For a listing of countries and the nature of their copyright relations with the United States, see Circular 38a, International Copyright Relations of the United States."

oh damn no, you are right. there has to be a decision taken on this. this is really demotivating and makes us insecure about the hardwork and love we put in to create art.

looks like you can purchase a print of all stuff submited there.. even if the file don't have resolution enough to be printed.

I want send an email to them, maybe if we (all ripped artists) send messages, they can change this system and request written authorizations to make the prints available.

It's not just photobucket ...if you go to qoop ...on their main page is a rolling list of sites LIKE photobucket under "Q Connect"...

SO you would have to search EVERYONE of those sites for someone pillfering your work. ..and then that is IF they happen to be using QOOP to sell thru. THey could be using cafe press ...or zazzle ..or prolly any of 80 other sites you dont even know about ....

this is ALL fucked up...big time...

Some major math needs to be done... IS it worth sueing these bastards?...if they cant pay ...take their computer...Keep doing it over and fuckin over till EVERY fucking asshole in the world thinks twice about losing their computer before they steal something ..

Sueing intra-state is HARD and COSTLY ...and who says these assholes are even in this country let alone the odds of them being in your own state.

Unless you are selling your own prints out the wazoo ....paying a lawyer for just a cease and desist order everytime you find an asshole could put you in the poor house...

what a fucked up system...

Instead of fucking getting in bed with every fucking corporate asshole they can find to rob poor artists here blind...Why isnt DA putting the same energy into a VLA ( volunteer Lawyers for the Arts ) to protect what DA has gathered.....yeah ...i'll tell you why ....

( biggest SNEER i ever produced in my life )

AOL used to care enuff to go after spammers and sue them blind and then give away their assests in contests... WHy doesnt DA care enuff to go after infringing assholes?..

i always bitched that the end user agreement absolves DA of 3rd party infringement. THere's a fucking invitation to themselves to ripp from you and sell under another name...boy ..would i like to prove that.
